Terms and Conditions
1. Scope
These Terms and Conditions apply to the use of the software „Firmeo“ as well as the associated website firmeo.ai, operated by Arnold Freissling, Rossatzbach 3/2, 3602 Rossatz (hereinafter „we“). They are directed exclusively at entrepreneurs within the meaning of § 1 of the Austrian Business Code (UGB); a consumer transaction within the meaning of the Consumer Protection Act (KSchG) does not exist. Conflicting or supplementary terms of the user do not become part of the contract unless we expressly agree to them in writing.
2. Subject Matter of the Contract
Firmeo is a cloud-based software (Software as a Service) for B2B new customer acquisition: lead search, AI-assisted research, data enrichment, as well as email, LinkedIn and social media outreach. During the early access and beta phase, access is granted via the waitlist; the range of features and availability may still change.
3. Registration & Conclusion of the Contract
The contract is concluded upon the activation of an account or the conclusion of a paid plan. You are responsible for the accuracy of your information and for keeping your access credentials confidential.
4. Services & Usage Allowance
The scope of services depends on the chosen plan. Individual actions (e. g. find company, enrich, AI research, AI mail) are counted against the respective monthly allowance. The allowance depends on the chosen plan; additionally purchased allowances do not expire.
5. Prices & Payment
The prices shown on the pricing page at the time of the order apply, plus any applicable value added tax. Billing is handled through our payment service provider; subscriptions are billed in advance either monthly or annually, depending on your choice. Invoices are due for payment without deduction.
6. Term & Cancellation
Unless otherwise agreed, subscriptions can be cancelled monthly; for annual payment, the respective term applies. Cancellation is possible via the account or by email to support@firmeo.ai.
7. Obligations of the User
You undertake to use Firmeo exclusively in a legally compliant manner, in particular in accordance with the GDPR, the Austrian Telecommunications Act (TKG), the Austrian Act Against Unfair Competition (UWG) and the applicable rules on email and LinkedIn communication. Unsolicited bulk sending (spam) is prohibited. You are yourself responsible for the lawfulness of your campaigns, content and recipient lists, as well as for the existence of the required legal bases.
8. AI-Assisted Features
Firmeo uses AI for research and text generation. Despite source verification and anti-hallucination checks, AI results may be incomplete or erroneous. You are obliged to review generated content before use. The transparency and due diligence obligations required under the EU AI Act when using it towards third parties are incumbent upon you.
9. Availability
We strive for high availability but cannot guarantee it during the early access phase. Maintenance work, updates or disruptions at third-party providers (e. g. email or LinkedIn providers) may lead to temporary limitations.
10. Warranty
The statutory warranty provisions for business-to-business transactions apply. Defects must be reported without delay after they are detected. No particular suitability for a purpose beyond the subject matter of the contract is warranted.
11. Liability
We are liable without limitation in cases of intent and gross negligence, as well as under mandatory statutory provisions. In cases of slight negligence, we are liable only for the breach of essential contractual obligations and limited in amount to the typical, foreseeable damage, at most to the fee paid in the last twelve months. We are not liable for lost profits, data loss, or for outages or changes to third-party services.

13. Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. The exclusive place of jurisdiction is the court with subject-matter jurisdiction in Krems an der Donau, Austria. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
